Federal Drug Crime Career Offender

Today we are going to talk briefly about mandatory prison sentences on certain drug offenses.

You have to be very careful if you’ve been charged with a drug offense, whether it be possession of drugs, furnishing a scheduled drug, or under the worst case scenario, trafficking or aggravated trafficking in scheduled drugs. Now, possession of a single pill of Oxycodone is a felony offense. That means having a single Oxycodone pill in your possession will subject you to a minimum sentence that includes probation and a possible stiff prison sentence. Drug possession cases are very serious cases. Now, when you’ve got lots of pills or you have lots of cocaine or lots of marijuana or lots of crack cocaine or heroin or whatever the drug of choice may be, you are more likely looking at a drug trafficking offense or aggravated drug trafficking charge.

The danger here is that if you begin to accumulate a history of drug offenses and, under the worst case scenario, are ever charged in the future by the federal government with a drug crime, you’re looking at a stiff prison sentence under the career offender laws. Now, a person would be a career offender in the federal system, if they have two or more prior felony convictions for a crime of violence and/or a drug trafficking crime. So, for example, if you have prior conviction for an aggravated assault case and drug trafficking charge and then you are picked up by the Feds on a drug offense, your case falls under the career offender guidelines. If you fall under the career offender prong of the guidelines, you’re facing a guideline sentence range of 360 months (30 years) to life.

It is so important to avoid drug convictions and crime of violence convictions at the state level because of the severe consequences down the road if the next charge goes federal.
