STATE v. A.F.

Offense: Burglary (Class B felony)

Maximum Penalty: 10 years prison and a fine of $20,000.00

Summary: Client allegedly broke into an acquaintance’s home and stole a TV, DVD player, PS3, various DVDs & CDs as well as cash.  Client was questioned and charged with Burglary by the police.  Client’s finger prints were found on the windowsill above the garage of the home.

Result: Client had a bad drug habit and was placed on deferred disposition for a period of 2 years.  At the end of the 2 year period and assuming that the client remained clean and sober and hadn’t committed any new crimes, the burglary would be dismissed and the client would plead guilty to 2 misdemeanor charges: theft and criminal trespass.  This arrangement allowed the client to keep his/her life intact.
