Possession of sexually explicit material is intentionally or knowingly transporting, exhibiting, purchasing, possessing, or accessing with the intent to view any material known to depict someone under the age of 16 (excluding spouses) engaging in sexually explicit conduct.

This is a Class D (misdemeanor) crime in Maine unless the victim is under the age of 12 or the accused has been convicted of a similar crime in the past.  In such cases, it may be prosecuted as a Class C (felony) crime.
