OUI / DUI Defense Lawyers in Falmouth, ME

Falmouth Maine Operating Under the Influence (OUI) Lawyers

Falmouth is a small city in Cumberland County, Maine. Falmouth borders Portland on the north, and runs from the coast of Maine inland, past I-95, all the way to Highland Lake.

With a population of 11,185 during the 2010 census, Falmouth’s beautiful location and close proximity to Portland has made it one of the largest and most affluent areas in Maine since the 1950s. Before World War II, Falmouth was a rural area.

However, its population exploded following the War, when Portland residents and Navy personnel from the Casco Bay base moved out of the city and into the suburbs. In large part because of its affluence, the suburb of Falmouth is now home to one of the most prestigious educational systems in not only the state, but across the country.

Statistics put a number on Falmouth’s affluence, compared to the rest of Maine. Falmouth’s median household income in 2013 was $83,144. The rest of Maine was barely more than half of that, at $46,974.

The prosperity of its residents also plays into Falmouth’s low crime rate, one of the lowest in the region, and well below the state and national averages.

Falmouth Court Location

If you get arrested and charged for operating under the influence (OUI) in Falmouth, your case will be handled by the Maine District Court in Portland, Maine. Please see our page on the Portland Court here.

OUI / DUI Penalties in Falmouth

If the OUI investigation gathers strong evidence of an operating under the influence crime, you could end up getting convicted on drunk driving or drugged driving charges.

The penalties of an OUI conviction continue to change and carry heavier penalties and fines as politicians continue to cater to special interest groups that want to punish drunk drivers.

As a result, the sanctions for an OUI conviction, even one that does not involve a crash or injury,  are shockingly high for the severity of the crime:

No. of Offense (Last 10 Years) License Suspension Jail Time Minimum Fine
1st Offense 150 Days 0 – 96 Hours $500
2nd Offense 3 Years 7 Days $700
3rd Offense 6 Years 30 Days $1,100
4th Offense 8 Years 6 Months $2,100

Prosecutors

Because Falmouth is in Cumberland County, the prosecutor who will be pursuing charges against you will come from the Cumberland County District Attorney’s Office. This office is led by Stephanie Anderson, and has been since 1991. She divides her office of prosecutors into teams, each of which is led by an experienced district attorney, and each of which is responsible for specific police departments.

No matter where it happens, an arrest for drunk driving is serious. Advocates for road safety have long been a loud group, and politicians have listened to their demands to severely punish anyone caught driving drunk, even if they haven’t hurt anyone.

As a result, a charge for OUI can be a life-altering event. If convicted on the charge, you could face serious penalties, including severe fines, difficult restrictions on your driving ability, and even jail time.

Luckily, a charge for OUI is not the end of the story. It’s only an accusation. The prosecutor still has to amass enough evidence to convince a jury that their accusation of drunk driving is true.

This is where attorney William T. Bly comes in. His experience defending people against OUI charges has given him incredible insight and lessons on how the charges are pursued, and the best ways to prevent them from turning into a conviction that can severely impact your livelihood.

Willliam Bly has developed a track record of success, successfully defending clients against OUI charges in a wide variety of ways, including getting outright acquittals by challenging the police officer’s conduct during the stop, or showing the unreliability of breathalyzers.
