OUI / DUI Defense Lawyers in Millinocket, ME

Millinocket Maine Operating Under the Influence (OUI - DUI) Lawyers-min

Millinocket is a town in Penobscot County, Maine. With a population of 4,506 at the 2010 census, it’s one of the largest settlements in the northern, inland part of the state of Maine.

Like many others in Maine, the town of Millinocket grew around its paper mills, which employed many if not most of the people in the area. However, in 2003, the mills went bankrupt and laid off nearly all of their workers. Since then, Millinocket has struggled to reshape its identity and economy.

Service and tourism jobs have become prominent, as the town lies near both Maine’s tallest mountain, Katahdin, and largest lake, Moosehead Lake.

The loss of the paper mills reflects itself in stats that show that Millinocket’s 2010 population was 13.9% below its 2000 total, and that its median household income has grown much slower than Maine’s average, only increasing to $34,665 in 2013 from $29,337 in 2000.

This puts Millinocket below the state’s average for prosperity. Nevertheless, crime rates in Millinocket are well below both the state and national average, despite a relatively small police force for the state of Maine, with only 1.13 officers per 1,000 residents, compared to the Maine average of 1.69.

Millinocket Court Location

If you get arrested for operating under the influence (OUI) in Millinocket, your case could either be heard at the Millinocket District Court, or at the Lincoln District Court. This split is due to the renovation of the Millinocket Municipal Building, which houses the Millinocket District Court. This renovation fixed a leaking roof and mold problems, which had led to air quality concerns.

While the Municipal Building was being renovated, the docket for the Millinocket District Court was transferred to the Lincoln District Court. When the Municipal Building reopened, on June 24, the District Court reopened for business, as well. While its docket is still currently split between the Millinocket District Court and the Court in Lincoln, Maine, it is slowly being moved back to Millinocket.

If your case is to be heard at the Millinocket District Court, then you should appear at this courthouse, when requested to do so. The Millinocket District Court is located on the second floor of the Millinocket Municipal Building, which is found at 207 Penobscot Avenue, in Millinocket, Maine . The Municipal Building is a two-story, square brick building. You can find directions on Google Maps, or on the court’s website.

If your case is to be heard at the Lincoln District Court, please see our page on that court.

Parking

Parking is limited in the area. There are several spots on the street right outside the Millinocket Municipal Building, but if these are taken, you’ll have to find alternatives.

Much of the parking available in the town is found right around the courthouse, or on Penobscot Avenue, or on Aroostook Avenue, which runs parallel with Penobscot.

Driving up and down these streets should lead to a parking spot. Get to the area early, just to make sure you’re not late for your court appearance.

Courtroom

The Millinocket District Court is located on the second floor of the town’s Municipal Building. As a small town court, everything is fairly easy to find, once you’re inside. While the courtroom was recently renovated, the changes were made to the roof, to stop the leaking, there, and the buildup of mold.

Little was done to otherwise modernize the building. However, recent testing shows that the renovation was a success, so there’s no need to worry about the air quality in the court.

Prosecutors

The District Attorney for Penobscot County, Chris Almy, has a strict “no negotiation” policy when it comes to dealing with OUI / DUI charges.

Any prosecutor on his staff who drops down an OUI / DUI charge to something else knows that they’ll be looking for a new job, very soon. This is unfortunate, but also makes your decision on how to defend your case much easier; you can either plead guilty, or take the case to trial.

OUI / DUI Penalties in Millinocket

If the OUI investigation gathers strong evidence of an operating under the influence crime, you could end up getting convicted on drunk driving or drugged driving charges.

The penalties for an OUI conviction continue to change and carry heavier penalties and fines as politicians continue to cater to special interest groups that want to punish drunk drivers.

As a result, the sanctions for an OUI conviction, even one that does not involve a crash or injury,  are shockingly high for the severity of the crime:

No. of Offense (Last 10 Years) License Suspension Jail Time Minimum Fine
1st Offense 150 Days 0 – 96 Hours $500
2nd Offense 3 Years 7 Days $700
3rd Offense 6 Years 30 Days $1,100
4th Offense 8 Years 6 Months $2,100
