Today’s topic of discussion concerns out-of-state-drivers and Bureau of Motor Vehicle suspensions. The State of Maine is well known as a vacation area. People from all over the country come here to Maine for vacation. Unfortunately, folks who come here to vacation do occasionally get arrested for OUI.
If you’re from out of state and you are arrested for Operating Under the Influence (it might be called DWI or DUI in your state) in the State of Maine, the Maine Secretary of State will take the following action: Maine will move to suspend your right to operate your car or any motor vehicle whatsoever here in the State of Maine. The Maine Secretary of State does not have the power or the authority to suspend your home state driver’s license. Rather, it is up to your home state to take action against your license.
If the state of Maine suspends your driving privileges here, you are going to be required to take the Driver Education Evaluation Program which, in Maine, is a 20-hour course. If you don’t complete the course, you will be suspended by Maine indefinitely. That means your home state will eventually suspend you as well. So you really do need to deal with the Bureau of Motor Vehicle suspension that originates here in Maine. Keep in mind that even if you beat the criminal case but lose the BMV hearing, you are still required to take the DEEP course.
Again, while Maine cannot suspend your right to drive in any other state or your license itself, they can suspend your right to drive here in Maine. So it’s really important that when you receive notice of that suspension that you contact your attorney to discuss how he’s going to handle that Bureau of Motor Vehicle Suspension. It can make a huge difference on the criminal case. It can certainly have a long-lasting impact on your right to drive outside of Maine if you ignore that problem.
