In case you were wondering, you can be charged with driving drunk on a lawnmower; even if you’re mowing your own lawn! While pursuing the news today, I stumbled upon an article from Reuters where it was reported a man was arrested and charged with DUI on a lawnmower. The case is out of Florida. Apparently, the poor guy had just bought the lawnmower and was out mowing lawns in the hot summer sun so he got the bright idea to pick up a 12 pack of beer to cool off from the heat. He drank a bunch of those beers and continued to drink… all the way home. The police found him driving the wrong way down the highway. Needless to say, a DWI conviction will put an end to his lawn mowing days!
In Maine, you can be charged with OUI if you are operating a motor vehicle while under the influence of alcohol or drugs. A motor vehicle is defined to include any vehicle propelled by an engine, gas or electric. Therefore, a riding lawn mower would qualify as a motor vehicle.
Furthermore, in Maine, you can be charged with a DWI even if you are driving on private property… including driving on your own lawn or in your driveway. So remember, even if you’re just mowing your lawn on your Sears riding lawn mower, if you’re under the influence of alcohol or drugs, you could be arrested just like that poor sap in Florida.
